Dog Beaten on Austin Balcony Sparks Animal Cruelty Charges and Petition for Lifetime Ban
A disturbing animal cruelty case in Austin, Texas has sparked outrage after residents recorded video that appears to show a dog being beaten on a downtown apartment balcony in broad daylight. The footage, captured by neighbors at the SEVEN Apartments on West 7th Street, shows a man restraining the dog against a balcony railing and striking the animal while it whimpers and tries to escape.
Residents quickly alerted authorities, and the Austin Police Department responded to the scene after receiving multiple reports about the alleged abuse. Investigators with the APD Animal Cruelty Unit reviewed the video and determined the actions shown were consistent with unjustified pain and suffering.
Videos Trigger Police Investigation

According to police and court documents, witnesses provided officers with several videos taken from nearby apartments. The footage allegedly shows the man repeatedly striking the dog while restraining it with objects such as patio furniture and a belt or rope.
In one video, the dog—later identified as Boone—can reportedly be seen whimpering while standing near what appeared to be blood or an unknown liquid on the balcony. Another video shows the man attempting to pin Boone against the railing using patio chairs and striking the dog multiple times.
Authorities say they later searched the suspect’s apartment and recovered items believed to have been used in the incident, including a belt and a towel seen in the videos.
Dog Rescued and Placed in Protective Care
After reviewing the evidence, officers seized Boone from the apartment and transported him to Austin Animal Services, where he is now receiving care and evaluation. Officials described Boone as a senior dog showing fearful and defensive behavior, likely the result of trauma.

Despite the disturbing allegations, Boone is reported to be in generally good health. He will remain under the care of Austin Animal Services while the criminal case moves forward and will not be available for adoption or foster placement until the legal process concludes.
Arrest Made in Cruelty Investigation
Police later arrested 35-year-old John Kaschak, who now faces a charge of Cruelty to Animals, a third-degree felony. According to investigators, the arrest was made after detectives reviewed multiple videos, interviewed witnesses, and executed a search of the suspect’s residence.
Kaschak was booked into the Travis County Jail and later released on bond as the investigation continues.
Animal welfare advocates say cases like Boone’s highlight the importance of long-term protections, not just criminal charges. Research has shown that cruelty toward animals can be a warning sign of deeper behavioral issues, and without meaningful intervention, similar acts of violence may occur again.
